Employers should, and in some cases must, perform background checks. But there are certain rules to follow to perform background checks correctly, particularly where the checks are performed by third party providers. Employers can be sued for negligent hiring for not properly checking the background of a prospective employee, and negligent retention for keeping an employee who the employer has reason to believe may pose a danger to others. |
